Key Messages

Confidentiality of investigations

  • My investigations are confidential. I cannot comment on specific ongoing cases.
  • I can speak to general statistics, trends, and systemic issues observed across my investigations.

Record retention and information management

  • The Access to Information Act does not require institutions to create records. It applies once a record exists, regardless of form or medium.
  • Retention policies are essential and beneficial, but only when supported by proper training, clear accountability, and sound information-management principles.
  • To provide meaningful access, institutions must ensure records are created and retained in accordance with Information Management policies.

Orders

  • My order-making power is critical to an effective access to information system, as they provide the necessary tools to resolve complaints and ensure compliance.
  • Since I have the authority to issue orders, institutions such as the Department of National Defence and Library and Archives Canada have received the highest number of orders. Data now shows measurable improvements in their access practices.
  • By contrast, we are seeing a different trend with respect to the Privy Council Office, as reflected in our annual reports and published decisions, raising ongoing concerns about compliance and responsiveness.
