** Reporting changes

As per subsection 9(2) of the Access to Information Act (the Act), institutions are required to notify the Information Commissioner whenever they claim a time extension that is greater than 30 days. This is to be done at the same time the institution informs the requester of the time extension.

According to section 7.3.5 of the Treasury Board of Canada Secretariat's Access to Information Manual, institutions do not have to give notice to the Information Commissioner of extensions taken under paragraph 9(1)(c) of the Act since it is not necessary to specify the time period of the extension when giving notice to third parties under subsection 27(1) of the Act. Institutions are required to notify the Information Commissioner if a time extensions are claimed under paragraph 9(1)(c) in conjunction with time extensions under paragraphs 9(1)(a) and/or 9(1)(b).

As a result, we receive many time extension notices where only a paragraph 9(1)(c) time extension is claimed and no extension length is indicated. Therefore, we are unable to report the average length of each individual time extension claimed and have reported the average total extension length per time extension notice.

The statistics for 2013–2014 will now report the total number of time extension notices received (including those where no extension length is indicated), the average total time extension length claimed per notice, and the total number of time extensions claimed.
